COUNTY COURT/SMALL CLAIMS INFORMATION

A small claims suit is an action for damages where the amount in controversy does not exceed the sum of $5,000.00 exclusive of costs, interest and attorneys fees.

To file a small claims lawsuit you will need the following:

1. Original statement of claims, signed and notarized with one (1) copy per defendant being served with appropriate supporting documentation.

2. Original pre-trial summons with three (3) copies per defendant being served.  If you wish to have your pre-trial heard at the main courthouse located at 73 West Flagler Street, use this form.

3. Check payable to "Clerk of the Court" for the appropriate filing fee.

4. One (1) self addressed stamped envelope.

5. Check or money order for service per defendant, payable to "Bique International, Inc.," (our fee is based on county of service).

EVICTIONS

To file an eviction complaint you will need the following:

1. 3 Complaints for eviction.

2. 3 Summons (5 day) for eviction.

3. 3 Copies of notice to tenant.

4. 3 Copies of lease (if applicable).

5. 1 Stamped envelope addressed to tenant.

6. Self addressed stamped envelope if you wish to receive a conformed copy of the summons and complaint.

7. Cash, money order or business check for filing, in the appropriate amount payable to "clerk of the courts". 

8. Check or money order for service per defendant, payable to "Bique International, Inc.," (our fee is based on county of service).

20 DAY SUMMONS

To file a twenty (20) day summons (any amount in excess of $5,000.00) you will need the following:

1. Original complaint and one (1) copy per defendant being served.

2. Original summons (20 day) and one (1) copy per defendant being served.  Be sure to use the correct summons, i.e, individual summons and corporate summons.

3. Original civil cover sheet.

4. Check payable to the "Clerk of the Court" for the appropriate filing fee.

5. Self addressed stamped envelope if you wish to receive a conformed copy of the summons and complaint.

6. Check or money order for service per defendant, payable to "Bique International, Inc.," (our fee is based on county of service).

FEDERAL COURT CASES

If you are filing a federal lawsuit you will need the following:

1. Original and one (1) copy of Civil cover sheet.

2. Original and three (3) copies of complaint.  Add one (1) extra copy of the complaint per additional defendant being served.

3. Original and three (3) copies of summons.  Add one (2) extra copy of the summons per additional defendant being served.

4. Check payable to "Clerk of the Court".

5. Self addressed stamped envelope if you wish to receive a conformed copy of the summons and complaint.

6. Check or money order for service per defendant, payable to "Bique International, Inc.," (our fee is based on county of service).
